Terms and Conditions

Promoter: Australian Gift & Homewares Association Limited (ABN 49061196290) of Unit 58, 11-21 Underwood Road, Homebush NSW 2140

Competition Period: 9am AEST on Saturday 2nd August 2025 and ends at 3pm AEST on Wednesday 6th August 2025

Who can enter?

  1. 1. Entry is only open to Australian residents aged 18 years or over who attend the AGHA Melbourne Gift Fair between 2 and 6 August 2025.

Who can’t enter?
Directors, officers, management and employees (and their immediate families) of:

  1. A. the Promoter; and
  2. B. the agencies, companies or participating premises associated with this competition.

Where will the competition run? The competition will run at the AGHA Melbourne Gift Fair between 2 and 6 August 2025 at the Melbourne Convention and Exhibition Centre.

Qualifying Order: A qualifying order is an order that is:

  1. A. delivered or paid in full; or
  2. B. placed and unable to be cancelled,

on or before 28 August 2025.

Entry instructions: To enter, you must, during the Competition Period:

  1. A. attend the AGHA Melbourne Gift Fair between 2 and 6 August 2025 at Melbourne Convention and Exhibition Centre;
  2. B. place a minimum of 5 Qualifying Orders from 5 different exhibitors at the AGHA Melbourne Gift Fair;
  3. C. have each applicable exhibitor complete the ‘Order Your Way to $5k Passport’ at the time of placing an order;
  4. D. complete your details and submit the completed Passport at the AGHA Membership Desk prior to 3pm 6 August 2025;
  5. E. current members of the AGHA whose membership fees have been paid in full are eligible to receive a bonus entry for every completed Passport entry.

What can I win? The first three (3) drawn eligible entrants will each win a cash prize of AUD$5,000. Payment will be made by electronic transfer to the winner’s nominated bank account.

Total prize pool: The prize pool is valued at a maximum of AUD$15,000.

How many times can I enter? You can enter multiple times, provided each Qualifying Order is included on one entry.

For example, to be entitled to place two valid entries, an entrant will need to place at least 10 Qualifying Orders and submit two separate entry forms. Financial retailer members of the AGHA are eligible to receive a bonus entry for every completed Passport entry form.

How and when will the winners be informed?

  1. – The prize draw will take place at The Australian Gift and Homewares Association on 3 September 2025 at 11am at Unit 58, 11-21 Underwood Rd Homebush NSW 2140.
  2. – The winner will be notified by phone and email within 2 business days of the draw date. The winner’s first initial, surname and post code will be published on the Website www.agha.com.au/Melbourne-2025-5k.

Prizes must be claimed within 2 weeks of winner notification. At the time of claiming a prize, the winner must provide the Promoter with its nominated bank account details for receipt of the prize.

Proof of purchase: You hereby consent to the Promoter contacting applicable exhibitors to verify your orders included on an entry are Qualifying Orders. You may also be required to provide proof that an order is a Qualifying Order upon request. If the Promoter is unable to verify an order is a Qualifying Order, your entry may be disqualified.

Unclaimed prizes:

Prize claim date: 5pm (AEST) on 19/09/2025.
Unclaimed prize determination: 12pm (AEST) on 22/09/2025 at Unit 58, 11-21 Underwood Rd Homebush NSW 2140.
If a prize has not been accepted or claimed by the prize claim date above, or if, after making all reasonable attempts, the Promoter can’t contact a winner by that date, the entry will be discarded and a redraw will take place. Winners will be notified by email within 5 business days and published on the website by 26/09/2025. If any prize remains un-won, this will be published by 17/10/2025.

Collection and use of your personal information: The Promoter collects personal information (“PI”) to conduct the promotion. This may include disclosure to agents, contractors, service providers, prize suppliers and regulatory authorities. Entry is conditional on providing this PI. See our Privacy Policy.

General Terms and Conditions

1. These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions.

Entry

2. Your entry must be received during the Competition Period and will be deemed to be received only when received by the Promoter. If you return a Qualifying Purchase, your entry may be deemed invalid at the Promoter’s discretion (unless the product is defective). You will receive a return message confirming your entry. The Promoter is not liable for any problems with communications networks outside its reasonable control. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.

Prizes

3. Prizes and all elements of prizes must be taken as specified, as and when offered, and cannot be altered or changed in any way by you or will be forfeited. If forfeited, the Promoter will not be liable. If you forfeit the prize or any element of the prize for any reason, you will not be given cash or an alternative prize. Prizes are subject to additional terms imposed by suppliers or the Promoter.

4. The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a prize.

General

5. If you or your entry breach these Terms and Conditions materially, your entry (or all your entries) may be discarded. The Promoter may require you to produce documentation to verify your identity, age, residency, or employment. Failure to enforce any rights at any stage does not constitute a waiver.

6. You must not:

  • (a) Tamper with the entry process (e.g., bots, scripts);
  • (b) Jeopardise the fair conduct of the competition;
  • (c) Act disruptively or abusively;
  • (d) Damage the reputation of the Promoter or its partners;
  • (e) Breach any law; or
  • (f) Behave inappropriately.

7. The Promoter is not responsible for lost, delayed, or misdirected entries or correspondence beyond its control.

8. If any dispute arises regarding this competition, the Promoter will take reasonable steps to resolve it fairly. All other decisions by the Promoter are final.

9. Prizes are not transferable, exchangeable or redeemable for cash. If unavailable, the Promoter may substitute with a prize of equal or greater value, subject to necessary approvals.

10. By entering, you request that your full address not be published.

11. Printing or quality control errors outside the Promoter’s control do not invalidate valid claims. All valid prize claims will be honoured unless due to fraud or ineligibility.

12. If the competition cannot run due to factors beyond the Promoter’s control (e.g., tech issues, public health orders), the Promoter may suspend or cancel it or disqualify affected entries, subject to approvals.

13. The Promoter is not responsible for tax implications. You should seek independent financial advice. If any non-monetary consideration applies, market value GST rules apply.

Liability

14. You may have consumer rights under law (e.g., the Competition and Consumer Act 2010) that cannot be excluded. Visit www.accc.gov.au for details.

15. Subject to the above, the Promoter is not liable for any loss (including indirect or consequential loss), expense, damage, personal injury or death related to this competition or prize, except where liability cannot be excluded by law.

16. The Promoter is not liable for loss or delay in delivery of prizes or damage to prizes due to circumstances beyond its control. Prizes will only be delivered to Australian addresses.

17. This competition is not affiliated with Facebook, Instagram, or Twitter. You provide your information to the Promoter, not the platforms. You release all social platforms from liability.
